Council stresses ordinance on burning

At Monday's Neoga City Council meeting, council members discussed a recent letter of complaint they had received from ''concerned citizen'' about violations of the City's burn ordinance. The letter noted that some residents are burning garbage and that some fires burn or smolder beyond the legal time for extinction.


Council members agreed that a city ordinance is in place governing burning and that people who violate the ordinance will be identified and warned of the full extent of the ordinance.


Key provisions of the ordinance follow:


(a)No person shall cause or allow the open burning of garbage.


Garbage means rejected food wastes resulting from the handling, processing, preparation, cooling, cooking, spoiling and consumption of food and food products, and table leftovers.

Exemptions:


(1)The burning of leaves or paper between the hours of 6:00 a.m. and 6:00 p.m. Monday through Saturday provided that all of the following conditions are met:


a.Atmospheric conditions will readily dissipate contaminants;


b.Such burning does not create a visibility hazard on streets, alleys and public walkways;


c.Such burning does not become a nuisance, annoyance or discomfort to any other person by reason of the emission of smoke, fumes, fly ash, dust, soot or noxious odor; and


d.Such burning is constantly attended by a competent person until such burning is extinguished.


There shall be no burning of leaves or paper on Sunday or on any traditional holiday, including, but not limited to, Easter, Memorial Day, Fourth of July, Labor Day, Thanksgiving and Christmas.


a)Any person violating or aiding or abetting the violation of any provisions of section 42-2 is guilty of a petty offense and shall be fined not less than $25.00 nor more than $500.00.


(b)Each day a person fails to comply with the provisions of section 42-2 constitutes a separate offense.

Open burning of garbage is prohibited in Illinois. Garbage (food waste, plastic and diapers), trade waste (construction debris and roofing materials), used furniture, appliances and automobile parts are not considered household waste and may not be burned. However, you can burn household waste generated from a single home. Do not overlaod the burn barrel somore oxygen can reach the fire to burn safely and completely.
